Consumers in the Commonwealth have significant rights pursuant to the federal Fair Debt Collection Practices Act ('FDCPA') and the Massachusetts Consumer Protection Act ('Chapter 93A'). For example, the following is a brief list of unlawful collection activities:

False Statements - Debt collectors cannot:

Falsely claim that they are attorneys or government representatives;
Lie to you;
State that they will garnish your wages or seize your property when they do not have a right to do so;
Falsely claim that you have committed a crime;
Falsely represent that they operate or work for a credit reporting company;
Misrepresent the amount you owe;
Indicate that papers they send you are legal forms if they are not;
Indicate that papers they send to you are not legal forms if they are; Threaten you, or threaten legal action that they cannot legally pursue;
Contact you at work when you have told them it is inconvenient, or that you do not want to be contacted at work;
Fail to notify you that you have the right to dispute the debt; or,
Give false information to anyone, especially a third-party regarding your debt.

...and this is just a small sampling of your potential rights under these consumer protection statutes.
